On July 10, Global Automakers and the Alliance of Automobile Manufacturers filed the attached joint Motion to Dismiss the lawsuits that have been filed challenging the EPA's April Determination that the model year 2022-2025 greenhouse gas emission standards are no longer appropriate and should be adjusted.  The Motion argues that the lawsuits are improper given the EPA's finding that its April Determination "is not a final agency action" and that “the current standards remain in effect and there is no change in the legal rights and obligations of any stakeholders.”  Additionally, the challenges are not ripe, because the Determination does nothing more than signal the beginning of a rulemaking process to determine what adjustments should be made to the GHG emission standards.  Settled law shows that any challenge to EPA's actions must await until the completion of the rulemaking.
