Statement of Concern Regarding SB 642--Franchise Legislation

Global Automakers submitted a letter of concern regarding SB 642, a bill that amends the California motor vehicle dealer franchise laws by making void and unenforceable any voluntary agreement between a manufacturer and dealer that requires a waiver of a dealer's rights or a manufacturer's or distributor's duties under the franchise laws. Global Automakers is concerned about the breadth and scope of the provision and the unintended consequences that could result for both dealers and manufacturers if any individual agreement between a manufacturer and dealer that involves the waiver of a manufacturers' obligation under the franchise law is no longer possible in California.
