Global Automakers Submits Comments Supporting Adoption of Daubert Rule in Florida

On Friday, April 1, Global Automakers submitted joint comments with the Alliance of Automobile Manufacturers in the Florida Supreme Court urging the state to adopt the Daubert standard for the admissibility of expert testimony.

In 2013, the Florida Legislature revised §§90.702 and 90.704, Florida Statutes, to formally adopt the Daubert standard. However, the Florida Bar Code and Rules of Evidence Committee’s “Three Year Cycle Report” has recommended that the Florida Supreme Court not adopt the Daubert standard, arguing that rules concerning the admissibility of expert testimony are procedural and thus governed by court rules and not the statute. 

Global Automakers' comments request that the court not follow this recommendation, and to instead join the other 40 states that have adopted Daubert, as that rule is fair, reasonable, and the most effective way to filter unreliable testimony from evidence.
